By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility and Accounts

You must be at least 18 years old and able to form a binding contract to use the Service. When you create an account, you agree to provide accurate information and to keep it current. You are responsible for safeguarding your account credentials and for all activity that occurs under your account.

2. Acceptable Use

You agree not to:

  • Interfere with or disrupt the integrity or performance of the Service;
  • Attempt to gain unauthorized access to the Service or related systems;

3. SMS / Text Messaging Terms

By providing your mobile phone number and opting in, you consent to receive text messages from Caterable related to your account, the Service, and—where you have agreed—informational or promotional content.

  • Message frequency varies depending on your interactions with us and the Service.
  • Message and data rates may apply according to your mobile carrier plan; these charges are your responsibility.
  • You may opt out at any time by replying STOP, after which you will receive a single confirmation message and no further marketing texts unless you opt back in.
  • Reply HELP for assistance, or contact team@getcaterable.com.
  • Carriers are not liable for delayed or undelivered messages.

Your consent to receive text messages is governed by, and your mobile information is handled in accordance with, our Privacy Policy, including its commitment that mobile opt-in information is never shared with third parties or affiliates for marketing or promotional purposes.

4. Fees and Payment

Certain features of the Service may require payment. You agree to pay all applicable fees as described at the time of purchase. Unless otherwise stated, fees are non-refundable. We may change pricing prospectively upon reasonable notice.

5. Intellectual Property

The Service, including all software, text, graphics, and trademarks, is owned by Caterable or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CATERABLE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE twelve (12) MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify and hold harmless Caterable and its officers, directors, employees, and agents from any claims, damages, or expenses arising out of your use of the Service or your violation of these Terms.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will survive.

11. Governing Law

These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-laws principles. Any disputes will be resolved in the courts located in Fulton County, Georgia, unless otherwise required by applicable law.

12. Changes to These Terms

We may modify these Terms from time to time. When we do, we will update the "Last updated" date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
